RENTAL WAIVER

All rentals with The Playday Co. require a waiver to be signed prior to equipment use. Our waiver agreement is as follows:

Waiver and Release of Liability

PLEASE READ THE FOLLOWING carefully before signing this release waiver of liability. Soft play areas and bounce house rentals may result in injuries:

In consideration of the risk of injury that exists while participating in the use of bounce houses and soft play equipment, and in consideration of my desire to rent and participate in this activity, I hereby for myself, and any participants during my rental agreement, knowingly and voluntarily enter into this WAIVER AND RELEASE OF LIABILITY and hereby waive any and all rights, claims or causes of action of any kind arising out of my participation and/or any other participants in this activity.

I ________________________________________________ (I”) , have voluntarily elected to allow my child(ren) and their guests (both children and adults) to participate in playing on a bounce house(s) and/or soft play area, and I fully understand that this involves jumping on air filled entertainment toy(s) and/or in a soft play area that is composed of items that may fall over or children may fall from and that there are health and safety risks associated with this type of activity. I, therefore, assume all responsibility as it relates to risk of injury and/or death associated with this event and I will not hold The Playday Co. LLC, other vendors, and anyone affiliated with them responsible for any injuries incurred.

I hereby confirm that my child(ren) and their guests are in good physical condition and do not suffer from any disabilities or physical conditions that may place them or others at risk. I will otherwise prohibit their participation in this activity.

I hereby waive and release, indemnify, hold harmless and forever discharge The Playday Co. LLC from liability of any and all injuries including but not limited to death. It is my responsibility as the renter to ensure that the equipment remains safe during the rental period, and that all participants do not engage in rough or violent play, and that all participants abide by The Playday Co.'s rules.

I hereby agree to indemnify, defend, and hold harmless The Playday Co. LLC against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation, or otherwise brought to me or anyone on my behalf, including attorney's fees and any related costs.

I acknowledge that I have read, understand, and fully agree to the terms of this WAIVER AND RELEASE OF LIABILITY and its contents. I understand and confirm that by signing this WAIVER AND RELEASE OF LIABILITY I have given up considerable future legal rights. I have signed this WAIVER AND RELEASE OF LIABILITY voluntarily, under no duress or threat of duress, without inducement, promise, or guarantee being communicated to me. My signature is proof of my intention to execute a complete and unconditional WAIVER AND RELEASE of all liability to the full extent of the law. I am 18 years of age or
older and mentally competent to enter into this waiver.
